    AGREEMENT – HELLY HANSEN

    1. PARTIES

    Le site Web www.hellyhansen.com (le « site Web ») est un site exploité par Helly Hansen Benelux B.V. (le « marchand »), dont le numéro d’entreprise est le 0419669708 et l’adresse est le Lange Nieuwstraat 44, NL-2000, Antwerpen, Belgium. Le numéro de TVA du vendeur est BE0419669708.
    L’acheteur est la personne qui effectue la commande (« l’acheteur »). Le marchand offre les produits (« produits ») affichés sur le site Web.
    Ces conditions de vente, de même que la commande et la confirmation de commande, constituent la base contractuelle totale de l’achat (l’« entente »).

    2. PRIX

    Les prix affichés sur le site Web n’incluent pas toutes les taxes applicables.
    Les renseignements sur le montant total à payer par l’acheteur, y compris les droits environnementaux, le cas échéant, et tous les autres frais et coûts de livraison, ainsi que les détails de chaque article compris dans le montant total, sont affichés dans la commande (« commande ») avant que le paiement ne soit effectué.     3. CONCLUSION DE L’ENTENTE

    Dans la mesure où la loi le permet, le marchand ne peut être tenu responsable des erreurs d’écriture ou de frappe présentes dans la communication avec l’acheteur, et il n’y est pas lié.
    Si le produit est en rupture de stock, le marchand peut offrir à l’acheteur des renseignements sur des produits substituts.
    Le marchand se réserve le droit d’annuler des commandes effectuées par des acheteurs agissant dans la pratique du commerce.
    Afin de pouvoir faire des achats sur le site www.shop.hellyhansen.com, l’acheteur doit avoir atteint l’âge de la majorité dans sa province de résidence.

    4. PAIEMENT

    Le marchand accepte les paiements par MasterCard, Visa et Paypal. Il ne facturera pas le montant de l’achat sur la carte de débit ou de crédit de l’acheteur avant que le produit n’ait été expédié. Le marchand peut refuser la commande de l’acheteur si le paiement par carte de débit ou de crédit est refusé.

    5. LIVRAISON ET AUTRES

    La livraison sera effectuée à l’adresse indiquée sur la confirmation de commande. L’acheteur choisit une méthode de livraison parmi les choix offerts au moment de passer la commande.
    La date de la livraison dépendra de la méthode de livraison choisie et apparaîtra sur la confirmation de commande.

    6. RISQUES LIÉS AU PRODUIT

    La propriété du produit sera transférée à l’acheteur seulement lorsque le marchand aura reçu le paiement complet de toutes les sommes dues relativement au produit. Si le délai de livraison est atteint et que l’acheteur omet de prendre possession du produit une fois que celui ci est disponible, l’acheteur est alors responsable de la perte du produit ou des dommages causés à celui ci.

    7. DROIT D’ANNULATION

    L’acheteur peut annuler l’achat du produit conformément aux lois provinciales applicables. Le droit d’annulation peut être exercé, en vertu de ces lois et avant la livraison du produit, même si le produit n’est pas défectueux.

    -Nous commanderons votre nouvel article, et nous vous fournirons un numéro de retour et une étiquette d’expédition pour renvoyer le produit d’origine.

    -L’étiquette d’expédition que nous vous fournirons est à placer à l’extérieur du colis et vous permet de renvoyer le produit gratuitement.

    -Merci de bien vouloir conserver la preuve de votre envoi.

    LES ARTICLES PEUVENT ÊTRE RETOURNÉS/ÉCHANGÉS SOUS LES CONDITIONS SUIVANTES :

    -Les produits n’ont été ni lavés ni utilisés (vous pouvez bien sûr essayer l’article)

    -Le produit est placé dans son emballage d’origine et ce dernier n’est pas endommagé (un emballage ouvert avec soin peut être retourné)

    -Toutes les étiquettes sont attachées

    -Le produit est complet (par ex., les deux éléments d’une paire doivent être retournés)

    -Vous avez conservé une preuve d’envoi au cas où votre retour serait perdu durant le transport

    IMPORTANT : Si vous nous envoyez vos retours sans contacter le service client ni obtenir votre numéro de retour, nous ne serons peut-être pas en mesure de traiter votre retour, et nous ne pourrons pas garantir de remboursement.

    9. PRODUIT NE CORRESPONDANT PAS À LA COMMANDE, DÉFECTUEUX OU ENDOMMAGÉ AU COURS DE LA LIVRAISON

    Lorsque l’acheteur reçoit le produit, il lui incombe de vérifier si celui ci correspond à la commande, s’il a été endommagé au cours du transport ou s’il est défectueux. Dans l’un ou l’autre des cas, l’acheteur doit en informer le marchand conformément à la section 10. Le marchand remboursera ou échangera alors les produits endommagés, défectueux ou qui ne correspondent pas à la commande.

    10. CRÉCLAMATIONS EN CAS DE PRODUITS DÉFECTUEUX, ET DÉLAIS ALLOUÉS POUR LES RÉCLAMATIONS EN CAS DE RETARDS

    Si, après la livraison, l’acheteur constate que le produit est défectueux, il doit en informer le marchand, et ce, dans un délai maximal de deux mois après avoir remarqué le défaut. Toutes les réclamations et tous les avis de défectuosité doivent être transmis par écrit, soit en cliquant sur le lien « Pour nous joindre » au www.hellyhansen.com/customer-service ou en communiquant avec le marchand au 800 766 40.

    11. DÉFAILLANCE DU MARCHAND

    Si le produit est défectueux, ou si le marchand n’expédie pas le produit ou l’envoie plus tard que le délai de livraison prévu, et que le défaut et/ou le retard ne relèvent pas de l’acheteur ou de circonstances démontrant la responsabilité de l’acheteur, ce dernier peut exercer ses droits d’annulation en vertu des lois provinciales applicables. Le marchand sera alors responsable des frais de retour des produits retournés conformément à la présente section.

    12. DÉFAUT DE PAIEMENT DE L’ACHETEUR

    Si l’acheteur ne respecte pas ses obligations en vertu de la présente entente, et que cette non exécution des engagements ne relève pas du marchand ou de circonstances démontrant la responsabilité du marchand, ce dernier peut, selon les circonstances, exercer ses droits en vertu des lois provinciales applicables.
    Si l’acheteur n’effectue pas le paiement conformément à la présente entente, le marchand a le droit de confirmer l’entente et d’exiger que l’acheteur paie le montant total (engagement). En cas de violation substantielle de l’obligation de paiement ou d’autres violations substantielles du contrat, le marchand peut mettre fin à l’entente. Le marchand peut également choisir d’annuler l’entente si l’acheteur n’effectue pas le paiement dans un délai prolongé raisonnable déterminé par le marchand.

    13. FRAIS RELATIFS AUX INTÉRÊTS MORATOIRES ET AU RECOUVREMENT DE DETTES

    Si l’acheteur n’effectue pas le paiement en vertu de l’entente, le marchand peut percevoir des intérêts de 1,8 % (taux d’intérêt annuel de 18 % en vigueur).
    Si l’acheteur omet d’effectuer le paiement, le marchand peut, en donnant un préavis, soumettre la réclamation au recouvrement de dettes. L’acheteur est alors responsable des frais en vertu des lois provinciales applicables en matière de recouvrement.

    14. RENSEIGNEMENTS PERSONNELS – CONFIDENTIALITÉ

    Le marchand traitera les renseignements personnels de l’acheteur tout en respectant ses obligations en vertu de l’entente. Les renseignements personnels des acheteurs de moins de 16 ans ne seront pas recueillis sans le consentement d’un parent ou du tuteur légal de l’acheteur.
    Si l’acheteur a accordé son consentement (ou si un parent ou le tuteur légal d’une personne de moins de 15 ans a accordé son consentement), le marchand peut utiliser les renseignements personnels à d’autres fins, comme pour envoyer du matériel publicitaire ou des renseignements sur des produits. Un tel consentement volontaire et informé peut être donné par l’acheteur au moment de conclure l’entente.

    15. DISSOSIABILITÉ

    Si l’une des sections des modalités de la présente entente et de la confirmation de commande sont jugées invalides, les autres sections continueront d’être valides et exécutoires. Rien dans la présente entente ne porte atteinte aux droits des consommateurs prévus par la loi, lesquels ne peuvent faire l’objet ni d’une renonciation, ni d’une limitation dans le cadre d’un contrat.

    16. RÈGLEMENT DE LITIGES ET JURIDICTION

    Les parties doivent essayer de régler les litiges à l’amiable. Si une entente à l’amiable ne peut être conclue, la question devra être réglée devant les tribunaux.
    La présente entente est régie par la loi fédérale et les lois néerlandaises applicables. Le procès aura lieu en Hollande.

    AGREEMENT – HELLY HANSEN

    PARTIES

    The website www.hellyhansen.com (the “Website”) is a site operated by Helly Hansen Leisure Canada company number 13397901, (the “Seller”), whose registered address is at 8187 Swenson Way, Delta, BC V4G 1J5, Canada. The Seller may be contacted by phone 1-866-376-4183.
    The Buyer is the person stated as Buyer in the Order (the “Buyer”). The Seller supplies the products (“Products”) listed on the Website.
    These conditions of sale constitute, together with the Order and the Order Confirmation, the total contractual basis for the purchase (the “Agreement”).

    PRICES

    The prices referred to in the Website do not include all applicable taxes.
    Information about the total amount to be paid by the Buyer, including environmental fees, where relevant, and all other fees and delivery costs, and the purchase specification of each element of the total price, is given in the order (“Order”) before payment is made. All prices, fees, charges and costs are listed in Canadian dollars.

    ENTERING INTO THE AGREEMENT

    The Seller will acknowledge receipt of the Order electronically. All Orders are subject to acceptance by the Seller. As the acknowledgement of receipt is not acceptance of the Order, the Seller will confirm such acceptance to the Buyer by sending an e-mail that confirms that the Product has been despatched (the “Order Confirmation”). The Buyer shall review the Order Confirmation for any non-compliance with the Order both in terms of numbers, type of Product, price etc. Any discrepancy between the Order and the Order Confirmation shall be reported to the Seller as soon as reasonably possible either by clicking the contact us button www.hellyhansen.com/customer-service or by calling the Seller at 1-866-376-4183.
    To the extent permitted by law, the Seller cannot be held liable for and is not bound by writing or typing errors occurring in the communication with the Buyer.
    Where the Product is out of stock, the Seller may offer the Buyer information about alternative Products.
    The Seller reserves the right to cancel Orders made by Buyers acting in the course of trade.
    In Order to be able to shop at www.shop.hellyhansen.com , the Buyer must be over the age of majority in his or her province of residence.

    PAYMENT

    The Seller accepts payment with MasterCard, Visa and Paypal. The Seller will not charge the Buyer’s debit or credit card until the Product has been despatched. The Seller may decline the Buyer’s Order if the payment through the Buyer’s debit or credit card is declined.

    DELIVERY ETC.

    Delivery will be made to the address stated in the Order Confirmation. The Buyer chooses the method of delivery from the choices offered upon Ordering.
    The date of delivery will depend on the Buyer’s chosen method of delivery and will appear in the Order Confirmation.

    THE RISK FOR THE PRODUCT

    Ownership of the Product will only pass to the Buyer when the Seller receives full payment of all sums due in respect of the Product. If the time of delivery has arrived and the Buyer fails to have the Product delivered to him after the Product is made available to the Buyer, the Buyer will be responsible for any loss of or damage to the Product.

    RIGHT OF CANCELLATION

    The Buyer may cancel the purchase of the product pursuant to applicable provincial laws. The right of cancellation may, subject to such laws, be exercised even if the product is free from defects and prior to the product being delivered.

    Return Policy:

    If you are not satisfied with your product for any reason, you can return it to us or exchange for a different size within 30 days of receiving it. We will issue you a full refund for the price you paid for returned item(s).

    HOW TO RETURN A PRODUCT:

    -We will provide your return number and shipment label.

    -You can then send the product back free of charge with the shipment label provided by us on the outside of the box.

    -Please hold on to your proof of postage.

    -You have kept your proof of postage in case the return is lost in transit

    IMPORTANT: If you send us your returns without contacting customer service and acquiring the return number we may not be able to process your return, and cannot guarantee a refund.

    PRODUCT NOT IN ACCORDANCE WITH ORDER, DEFECTIVE OR DAMAGED ON DELIVERY

    When the Buyer receives the Product, he/she should examine whether or not the Product is in accordance with the Order and whether the Product has been damaged during transport or whether the Product suffers from defects. If the Product is not in accordance with the Order, has been damaged during transport or suffers from defects, the Buyer must give notice to the Seller in accordance with section 9. The Seller will refund or replace Products which are damaged, defective or not in accordance with the Order on delivery.
    CLAIMS IN THE EVENT OF DEFECTS AND PERIOD ALLOWED FOR CLAIMS IN THE EVENT OF DELAYS
    If at any time after delivery the Product is found to be defective, the Buyer must, within reasonable time after the Buyer became aware of the defect, send a notice to the Seller of the defect. This must be done no later than two months from when the defect was discovered by the Buyer. Any notices of default and notices of claims must be made in writing, either by clicking the contact us button www.hellyhansen.com/customer-service or by calling the seller at 1-866-376-4183.

    SELLER’S DEFAULT

    If the product suffers from defects or the Seller does not deliver the product or delivers the product later than the agreed time of delivery, and the defects and/or the delay is not caused by the Buyer or circumstances for which the Buyer is liable, the Buyer may exercise his or her cancellation rights under applicable provincial laws. The Seller will be responsible for any return shipment costs of any products returned pursuant to this section 10.

    BUYER’S DEFAULT

    If the Buyer does not fulfil its obligations under the Agreement, and the non-fulfilment is not due to the Seller or circumstances for which the Seller is liable, the Seller may, depending on the circumstances, exercise its rights under applicable provincial laws.
    If the Buyer does not submit payment according to the Agreement, the Seller can choose to confirm the Agreement and demand that the Buyer pays the purchase amount (fulfilment). In the event of material breach of the payment obligation or other material breaches of the contract, the Seller may terminate the Agreement. The Seller can also choose to cancel the Agreement if the Buyer does not submit payment within a reasonable extended period of time determined by the Seller.

    PENALTY INTERESTS/DEBT COLLECTION CHARGES

    If the Buyer does not submit the payable amount in accordance with the Agreement, the Seller may charge interest in the amount of & 1,8 % (effective annual interest rate of & 18 %).
    In the event of payment failure, the Seller may, upon prior notice, submit the claim to debt collection. The Buyer is liable for any charges pursuant to applicable provincial collection laws.

    PERSONAL INFORMATION – PRIVACY

    The Seller will process the Buyer’s personal information to comply with its obligations under the Agreement. The personal information of Buyers under the age of 16 will not be collected without consent from the Buyer’s parent or legal guardian.
    If the Buyer has provided his or hers consent (or the parent or legal guardian of someone under 15 has consented), the Seller may use the Buyer’s personal information for other purposes, for example sending advertising material or information about products. Such voluntary and informed consent may be given by the Buyer upon entering into the Agreement.
    The Buyer can contact the Seller’s Privacy Officer either by phone (604) 587-7083 or e-mail marshall.rutman@hellyhansen.com if the Buyer has any questions about the Seller’s collection, use, disclosure or storage of his or her personal information, or if the Buyer wants to withdraw his or her consent to the Seller’s continued collection, use, disclosure or storage of the Buyer’s personal information, or to change their personal information.

    SEVERABILITY

    If any part or parts of the terms and conditions contained in this Agreement and the Order confirmation are held to be invalid, the remaining parts will continue to be valid and enforceable. Nothing in this Agreement affects any statutory rights of consumers that cannot be waived or limited by contract.
    DISPUTE RESOLUTION AND JURISDICTION
    The parties shall try to settle any disputes amicably. If an amicable settlement cannot be reached, the matter shall be settled before the courts.
    This Agreement is regulated by applicable Canadian federal law and applicable provincial laws. Legal venue is in Ontario, Canada.

    These conditions of sale constitute, together with the Order and the Order Confirmation, the total contractual basis for the purchase (the “Agreement”).

Information about the total amount to be paid by the Buyer, including environmental fees, where relevant, and all other fees and delivery costs, and the purchase specification of each element of the total price, is given in the order (“Order”) before payment is made.

The Seller will bear the costs of returning the Product and will refund the price paid. When the Buyer returns a Product to the Seller because the Buyer has cancelled the Agreement in accordance with this section 7, the Seller will process the refund due to the Buyer as soon as possible and, in any case, within 30 days of the day the Seller receives the returned Product.

    9. Product not in accordance with order, defective or damaged on delivery

If the Product is not in accordance with the Order, has been damaged during transport or suffers from defects, the Buyer must give notice to the Seller in accordance with section 10.     AGREEMENT – HELLY HANSEN

    PARTIES

    The website www.hellyhansen.com (the “Website”) is a site operated by A/S Helly Hansen Imak, company number 36738 (the “Seller”), whose registered address is a Postboks 8m, 7100 Velje, Denmark. The sellers VAT number is 15799218. The buyer is the person stated as the buyer in the Order (the Buyer). The Seller supplies the Products (“Products”) listed on the Website.

    These conditions of sale constitute, together with the Order and the Order Confirmation, the total contractual basis for the purchase (the “Agreement”).

    PRICES

    The prices referred to in the Website include VAT but exclude delivery costs. Information about the total amount to be paid by the Buyer, including environmental fees, where relevant, and all other fees and delivery costs, and the purchase specification of each element of the total price, is given in the order (“Order”) before payment is made.

    ENTERING INTO THE AGREEMENT

    PAYMENT

    DELIVERY ETC.

    RIGHT OF CANCELLATION

    1.VERTRAGSPARTNER

    Die Webseite www.hellyhansen.com (nachfolgend: “Webseite”) wird betrieben von Helly Hansen Deutschland GmbH, HR-Nummer HRB122012, (nachfolgend: “Verkäufer”), Firmensitz Balanstrasse 73, Haus 10, 81541 Munich. Die Umsatzsteuer-Identifikationsnummer des Verkäufers lautet DE 160501320. Als Käufer wird die Person bezeichnet, die in der Bestellung angegeben ist (nachfolgend: “Käufer”). El Vendedor correrá con los gastos de devolución del Producto y reembolsará el precio pagado.     PRODUCTO NO CONFORME AL PEDIDO, DEFECTUOSO O DAÑADO EN EL MOMENTO DE LA ENTREGA

    Cuando el Comprador reciba el producto, deberá examinar si el Producto se ajusta o no al Pedido y si se ha dañado durante el transporte o presenta defectos. Si el Producto no se ajusta al Pedido, se ha dañado durante el transporte o presenta defectos, el Comprador debe notificar al Vendedor de acuerdo con la sección 9. El Vendedor deberá reembolsar o sustituir los Productos que estén dañados, defectuosos o que no se ajusten al Pedido en el momento de la entrega.

    RECLAMACIONES EN CASO DE DEFECTOS DEL PRODUCTO DESPUÉS DE LA ENTREGA
    Si en cualquier momento después de la entrega se observa que el Producto es defectuoso, el Comprador deberá, dentro de un plazo razonable después de que el Comprador haya tenido conocimiento del defecto, enviar una notificación al Vendedor.     Si el Comprador no envía el precio de la cantidad a pagar que aparece en el Acuerdo, el Vendedor podrá cobrar un interés del 1,5 %.

    INFORMACIÓN PERSONAL – PRIVACIDAD
    El Vendedor procesará la información personal del Comprador para cumplir con sus obligaciones en virtud del Acuerdo. El Vendedor también utilizará la información personal del Comprador para informarle de Productos similares a los que ha comprado, a menos que el Comprador informe al Vendedor de que no desea recibir dicha información.

Si el Comprador ha prestado su consentimiento previamente, el Vendedor podrá utilizar la información personal del Comprador para enviarle material publicitario o información sobre Productos diferentes de los ya adquiridos. El Comprador puede dar dicho consentimiento voluntario e informado en el momento del establecimiento del Acuerdo.

    RESOLUCIÓN DE CONFLICTOS Y JURISDICCIÓN
    
Las partes deberán tratar de resolver cualquier conflicto de manera amistosa. Si no es posible alcanzar un acuerdo amistoso, el asunto se someterá a los órganos jurisdiccionales españoles.
Este acuerdo y los posibles conflictos o reclamaciones relacionados con el ámbito del presente acuerdo se resolverán en conformidad con las leyes de España.

    1. PARTIES

    Si le produit est défectueux, ou si le marchand n’expédie pas le produit ou l’envoie plus tard que le délai de livraison prévu, et que le défaut et/ou le retard ne relèvent pas de l’acheteur ou de circonstances démontrant la responsabilité de l’acheteur, ce dernier peut exercer ses droits d’annulation en vertu des lois provinciales applicables. Le marchand sera alors responsable des frais de retour des produits retournés conformément à la présente section.

    11. DÉFAUT DE PAIEMENT DE L’ACHETEUR

    Si l’acheteur ne respecte pas ses obligations en vertu de la présente entente, et que cette non exécution des engagements ne relève pas du marchand ou de circonstances démontrant la responsabilité du marchand, ce dernier peut, selon les circonstances, exercer ses droits en vertu des lois provinciales applicables.
    Si l’acheteur n’effectue pas le paiement conformément à la présente entente, le marchand a le droit de confirmer l’entente et d’exiger que l’acheteur paie le montant total (engagement). En cas de violation substantielle de l’obligation de paiement ou d’autres violations substantielles du contrat, le marchand peut mettre fin à l’entente. Le marchand peut également choisir d’annuler l’entente si l’acheteur n’effectue pas le paiement dans un délai prolongé raisonnable déterminé par le marchand.

    12. FRAIS RELATIFS AUX INTÉRÊTS MORATOIRES ET AU RECOUVREMENT DE DETTES

    Si l’acheteur n’effectue pas le paiement en vertu de l’entente, le marchand peut percevoir des intérêts de 1,8 % (taux d’intérêt annuel de 18 % en vigueur).
    Si l’acheteur omet d’effectuer le paiement, le marchand peut, en donnant un préavis, soumettre la réclamation au recouvrement de dettes. L’acheteur est alors responsable des frais en vertu des lois provinciales applicables en matière de recouvrement.

    13. RENSEIGNEMENTS PERSONNELS – CONFIDENTIALITÉ

    Le marchand traitera les renseignements personnels de l’acheteur tout en respectant ses obligations en vertu de l’entente. Les renseignements personnels des acheteurs de moins de 16 ans ne seront pas recueillis sans le consentement d’un parent ou du tuteur légal de l’acheteur.
    Si l’acheteur a accordé son consentement (ou si un parent ou le tuteur légal d’une personne de moins de 15 ans a accordé son consentement), le marchand peut utiliser les renseignements personnels à d’autres fins, comme pour envoyer du matériel publicitaire ou des renseignements sur des produits. Un tel consentement volontaire et informé peut être donné par l’acheteur au moment de conclure l’entente.

    14. DISSOSIABILITÉ

    Si l’une des sections des modalités de la présente entente et de la confirmation de commande sont jugées invalides, les autres sections continueront d’être valides et exécutoires. Rien dans la présente entente ne porte atteinte aux droits des consommateurs prévus par la loi, lesquels ne peuvent faire l’objet ni d’une renonciation, ni d’une limitation dans le cadre d’un contrat.

    15. RÈGLEMENT DE LITIGES ET JURIDICTION

    Les parties doivent essayer de régler les litiges à l’amiable. Si une entente à l’amiable ne peut être conclue, la question devra être réglée devant les tribunaux.
    La présente entente est régie par la loi fédérale et les lois française applicables. Le procès aura lieu en France.

    Agreement – Helly Hansen

    1. Parties

The Seller’s VAT number is HU 8383053010. The buyer is the person stated as buyer in the Order (the “Buyer”). The Seller supplies the products (“Products”) listed on the Website.

    These conditions of sale constitute, together with the Order and the Order Confirmation, the total contractual basis for the purchase (the “Agreement”).

    2. Prices

    The prices referred to in the Website include VAT but exclude delivery costs. Information about the total amount to be paid by the Buyer, including environmental fees, where relevant, and all other fees and delivery costs, and the purchase specification of each element of the total price, is given in the order (“Order”) before payment is made.

    3. Entering into the agreement

    The Seller will acknowledge receipt of the Order electronically. All Orders are subject to acceptance by the Seller. As the acknowledgement of receipt is not acceptance of the Order, the Seller will confirm such acceptance to the Buyer by sending an e-mail that confirms that the Product has been despatched (the “Order Confirmation”). The Buyer shall review the Order Confirmation for any non-compliance with the Order both in terms of numbers, type of Product, price etc. Any discrepancy between the Order and the Order Confirmation shall be reported to the Seller as soon as reasonably possible either by clicking the contact us button http://www.hellyhansen.com/customer-service or by calling the Seller on 0680017725.

    To the extent permitted by law, the Seller cannot be held liable for and is not bound by writing or typing errors occurring in the communication with the Buyer.

    In order to be able to shop at the Website, the Buyer must be over 18, legally capable of entering into binding contracts and acting in his/her personal capacity and not in the course of trade. The Seller reserves the right to cancel Orders made by Buyers acting in the course of trade.

    4. Payment

    The Seller accepts payment with MasterCard, Visa and Paypal. The Seller will not charge the Buyer’s debit or credit card until the Product has been despatched. The Seller may decline the Buyer’s Order if the payment through the Buyer’s debit or credit card is declined.

    5. Delivery etc.

    Delivery will be made to the address stated in the Order Confirmation. The Buyer chooses the method of delivery from the choices offered upon ordering.

    The date of delivery will depend on the Buyer’s chosen method of delivery and will appear in the Order Confirmation. If more than one Product is ordered, the Seller reserves the right to send the Products in separate shipments.

    6. Ownership of the product

    Ownership of the Product will only pass to the Buyer when the Seller receives full payment of all sums due in respect of the Product. If the time of delivery has arrived and the Buyer fails to have the Product delivered to him after the Product is made available to the Buyer, the Buyer will be responsible for any loss of or damage to the Product.

    7. Right of cancellation

    The Buyer may cancel the purchase of the Product at any time for any or no reason within seven working days, beginning on the day after he/she received the Product. The right of cancellation may be exercised even if the Product is free from defects and either before or after the Product has been delivered. Where the Product has been delivered and the Buyer wants to cancel the purchase, the Buyer must return the Product to the Seller. The Seller will bear the costs of returning the Product and will refund the price paid.     9. Product not in accordance with order, defective or damaged on delivery

    When the Buyer receives the Product, he/she should examine whether or not the Product is in accordance with the Order and whether the Product has been damaged during transport or whether the Product suffers from defects. If the Product is not in accordance with the Order, has been damaged during transport or suffers from defects, the Buyer must give notice to the Seller in accordance with section 10. The Seller will refund or replace Products which are damaged, defective or not in accordance with the Order on delivery.

    10. Claims in the event of defects of the product after delivery

    If at any time after delivery the Product is found to be defective, the Buyer must, within reasonable time after the Buyer became aware of the defect, send a notice to the Seller of the defect. This must be done no later than two months from when the defect was discovered by the Buyer.     12. Personal information – privacy

    The Seller will process the Buyer’s personal information to comply with its obligations under the Agreement. The Seller will also use the Buyer’s personal information to inform the Buyer of Products similar to those purchased by the Buyer, unless the Buyer tells the Seller that he/she does not want to receive such information.

    Where the Buyer has provided his/her prior consent, the Seller may use the Buyer’s personal information for sending the Buyer advertising material or information on the Seller’s Products different from those purchased by the Buyer. Such voluntary and informed consent may be given by the Buyer upon entering into the Agreement.

The Buyer shall review the Order Confirmation for any non-compliance with the Order both in terms of numbers, type of Product, price etc. Any discrepancy between the Order and the Order Confirmation shall be reported to the Seller as soon as reasonably possible either by clicking the contact us button http://www.hellyhansen.com/customer-service or by calling the Seller on 0800 789 513.

    To the extent permitted by law, the Seller cannot be held liable for and is not bound by writing or typing errors occurring in the communication with the Buyer.

    Where the Product is out of stock, the Seller may offer the Buyer information about alternative Products.

    In order to be able to shop at the Website, the Buyer must be over 18, legally capable of entering into binding contracts and acting in his/her personal capacity and not in the course of trade. The Seller reserves the right to cancel Orders made by Buyers acting in the course of trade.

    PAYMENT

    The Seller accepts payment with MasterCard, Visa and Paypal. The Seller will not charge the Buyer’s debit or credit card until the Product has been despatched. The Seller may decline the Buyer’s Order if the payment through the Buyer’s debit or credit card is declined.

    DELIVERY ETC.

    Delivery will be made to the address stated in the Order Confirmation. The Buyer chooses the method of delivery from the choices offered upon ordering.

    The date of delivery will depend on the Buyer’s chosen method of delivery and will appear in the Order Confirmation. If more than one Product is ordered, the Seller reserves the right to send the Products in separate shipments.

    OWNERSHIP OF THE PRODUCT

    Ownership of the Product will only pass to the Buyer when the Seller receives full payment of all sums due in respect of the Product. If the time of delivery has arrived and the Buyer fails to have the Product delivered to him after the Product is made available to the Buyer, the Buyer will be responsible for any loss of or damage to the Product.

    RIGHT OF CANCELLATION

    The Buyer may cancel the purchase of the Product at any time for any or no reason within seven working days, beginning on the day after he/she received the Product. The right of cancellation may be exercised even if the Product is free from defects and either before or after the Product has been delivered. Where the Product has been delivered and the Buyer wants to cancel the purchase, the Buyer must return the Product to the Seller. The Seller will bear the costs of returning the Product and will refund the price paid.     PRODUCT NOT IN ACCORDANCE WITH ORDER, DEFECTIVE OR DAMAGED ON DELIVERY

    DISPUTE RESOLUTION AND JURISDICTION

    This Agreement and any dispute or claim arising out or in connection with the subject matter of this Agreement will be governed by the laws of Italy.

    AGREEMENT – HELLY HANSEN

    PARTIES

    The website www.hellyhansen.com (the “Website”) is a site operated by Helly Hansen Benelux, company number 14048192, (the “Seller”), whose registered address is at Holtum Noordweg 77, NL-6121 RE Born, Holland. The Seller’s VAT number is NL 802585759B01. The buyer is the person stated as buyer in the Order (the “Buyer”). The Seller supplies the products (“Products”) listed on the Website.

    These conditions of sale constitute, together with the Order and the Order Confirmation, the total contractual basis for the purchase (the “Agreement”).

    PRICES

    The prices referred to in the Website include VAT but exclude delivery costs. Information about the total amount to be paid by the Buyer, including environmental fees, where relevant, and all other fees and delivery costs, and the purchase specification of each element of the total price, is given in the order (“Order”) before payment is made.

    ENTERING INTO THE AGREEMENT

    The Seller will acknowledge receipt of the Order electronically. All Orders are subject to acceptance by the Seller.     SALGSBETINGELSER – HELLY HANSEN AS

    PARTER

    Selger er Helly Hansen AS, Solgårdskog 139, 1599 Moss, registrert i Brønnøysund-registeret med org.nr.: 912359999 og blir i det følgende benevnt “selger”. Kjøper er den som er oppgitt som kjøper i bestillingen.

    Disse salgsbetingelsene utgjør sammen med bestillingen og ordrebekreftelsen, det samlede avtalegrunnlaget for kjøpet.

    PRISER

    Prisene som er oppgitt i nettbutikken inkluderer merverdiavgift. Opplysninger om de totale kostnadene kjøper skal betale, inklusive miljøutgifter og alle andre avgifter og leveringskostnader samt spesifisering av de enkelte elementene i totalprisen, gis i bestillingen før betaling blir foretatt.
    Vareleveranser til Svalbard eller Jan Mayen blir solgt uten tillegg av merverdiavgift, jf lov av 19. juni1969 nr. 66 om merverdiavgift § 16.

    AVTALEINNGÅELSE

    Avtalen er bindende for begge parter når kjøpers bestilling er mottatt av selger. Selger er ikke ansvarlig for eller bundet av skrive- eller tastefeil som fremkommer overfor kjøper.
    Selger forbeholder seg retten til å kansellere en bestilling eller en del av en bestilling dersom produktet er utsolgt. Det tas videre forbehold om kansellering av ordrer som selger legger til grunn er beregnet for videresalg.
    For å kunne handle på www.hellyhansen.com eller www.shop.hellyhansen.com må du ha fylt 18 år.

    ORDREBEKREFTELSE

    Ved mottak av kjøpers bestilling, vil selger bekrefte ordren ved å sende en ordrebekreftelse. Kjøper skal kontrollere at ordrebekreftelsen stemmer overens med bestillingen med hensyn til antall, varetype, pris osv. Er det ikke samsvar mellom bestillingen og ordrebekreftelsen, skal kjøper ta kontakt med selger så snart som mulig på samme måte som beskrevet i punkt 10.

    BETALING

    Varen betales på det tidspunktet varen blir sendt fra selger. Dersom kjøper bruker kredittkort eller debetkort ved betaling, blir kjøpesummen reservert på kortet ved bestilling. Dersom reservasjon ikke kan foretas, forbeholder selger seg retten til å kansellere bestillingen. Ved betaling med kredittkort, vil lov om kredittkjøp m.m. av 21. juni 1985 nr. 82 komme til anvendelse.

    LEVERING M.V.

    Levering skjer til den adresse som er oppgitt i bestillingsordren, eventuelt til adressens tilhørende postutleveringssted. Kunden velger leveringsmåte innenfor de valg som tilbys ved bestilling.
    Leveringstidspunktet vil avhenge av kundens valg av leveringsmåte og vil fremgå av bestillingsordren. Dersom det bestilles mer enn én vare har selger rett til å sende varene i separate forsendelser.

    RISIKOEN FOR VAREN

    Risikoen for varen går over på kjøper når tingen er overtatt av kjøper i henhold til
    avtalen. Hvis leveringstiden er kommet og kjøper unnlater å overta en vare som er stilt til kjøpers rådighet etter avtalen, har kjøper likevel risikoen for tap eller skade som skyldes egenskaper ved varen selv.

    ANGRERETT

    Kjøper kan angre kjøpet av varen etter lov av 21. desember 2000 nr. 105 om opplysningsplikt og angrerett m.v. ved fjernsalg og salg utenfor fast utsalgssteds (angrerettloven) bestemmelser. Angrerett kan benyttes selv om varen er mangelfri og før varen er levert.
    Kjøper må skriftlig informere selger som anvist i punkt 10 om bruk av angreretten innen 14 dager etter at varen, opplysninger om angrerett og angrerettsskjema er mottatt. Selger betaler kostnadene for returforsendelsen.

    UNDERSØKELSE AV VAREN

    Når kjøper mottar varen, oppfordres det at han eller hun i rimelig utstrekning undersøker om den er i samsvar med bestillingen, om den har blitt skadet under transporten eller om den ellers har mangler. Hvis varen ikke samsvarer med bestillingen eller har mangler, må kjøper melde fra til selger ved reklamasjon.

    REKLAMASJON VED MANGEL OG FRIST FOR Å MELDE KRAV VED FORSINKELSE

    Dersom det foreligger en mangel ved varen, må kjøper innen rimelig tid etter at kjøper oppdaget den, gi selger melding om at han eller hun vil påberope seg mangelen og senest innen to måneder fra det tidspunkt da kjøper oppdaget mangelen. Reklamasjon til selger skal skje skriftlig, enten til selskapets postadresse eller gjennom kontaktskjemaet på websiden.

    KJØPERS RETTIGHETER VED FORSINKELSE OG MANGEL

    Dersom varen har en mangel eller selger ikke leverer varen eller leverer den for sent i henhold til avtalen mellom partene, og dette ikke skyldes kjøper eller forhold på kjøpers side, kan kjøper gjøre gjeldende beføyelsene i forbrukerkjøpslovens kapittel 5 og 6. Kjøper kan ved mangler holde kjøpesummen tilbake, heve avtalen, velge mellom retting og omlevering, kreve prisavslag og kreve erstatning fra selger. Ved forsinkelse kan kjøper holde kjøpesummen tilbake, heve avtalen, kreve oppfyllelse og kreve erstatning fra selger.

    SELGERS RETTIGHETER VED KJØPERS MISLIGHOLD

    Dersom kjøper ikke betaler eller oppfyller de øvrige pliktene etter avtalen, og dette ikke skyldes selger eller forhold på selgers side, kan selger etter omstendighetene gjøre gjeldende beføyelsene i forbrukerkjøpsloven kapittel 9. Dersom kjøper ikke betaler, kan selger fastholde kjøpet og kreve at kjøper betaler kjøpesummen. Ved vesentlig betalingsmislighold eller annet vesentlig mislighold fra kjøper kan selger heve avtalen, med mindre kjøpesummen er betalt. Selger kan også heve kjøpet dersom kjøper ikke betaler innen en rimelig tilleggsfrist for oppfyllelse som selger har fastsatt.

    RENTER VED FORSINKET BETALING/INKASSOGEBYR

    Dersom kjøper ikke betaler kjøpesummen i henhold til avtalen, kan selger kreve renter av kjøpesummen etter lov om renter ved forsinket betaling av 17. desember 1976 nr. 100.
    Ved manglende betaling kan kravet, etter forutgående varsel, bli sendt til inkasso, og kjøper kan da bli holdt ansvarlig for gebyrer etter lov om inkassovirksomhet og annen inndrivning av forfalte pengekrav, jf lov av 13. mai 1988 nr. 26 om inkassovirksomhet og annen inndrivning av forfalte pengekrav.

    GARANTI

    Eventuelle garantier gjelder i tillegg til de rettigheter kjøper har etter ufravikelig lovgivning. En garanti innebærer dermed ingen begrensninger i kjøpers rett til reklamasjon og krav ved forsinkelse eller mangler etter punkt 11.

    PERSONOPPLYSNINGER

    Selger vil innhente og lagre personopplysninger som er nødvendig for at selger skal kunne gjennomføre forpliktelsene etter avtalen. Personopplysningene til kjøper under 15 år vil ikke innhentes med mindre selger har samtykke fra foreldre eller foresatte.
    Selger vil ved samtykke fra kjøper benytte kjøpers personopplysninger til andre formål, for eksempel til å sende kjøper reklame eller informasjon ut over det som er nødvendig for å få gjennomført avtalen. Slikt frivilling og informert samtykke kan gis av kjøper ved avtaleinngåelse.
    Kjøper kan kontakte selger, enten på telefon 0800 14 319 eller gjennom kontaktskjemaet på websiden ved spørsmål om selgers bruk av personopplysninger eller for stans av bruk eller endring av personopplysningene.

    KONFLIKTLØSNING OG VERNETING

    Forbrukerkjøpsloven får anvendelse på ditt kjøp. Etter Forbrukerkjøpsloven må du varsle oss innen rimelig tid etter at du har oppdaget eller burde ha oppdaget en mangel ved dine varer. Slik reklamasjon må skje senest to år etter at du mottok varene. I fall varene er ment å vare vesentlig lenger enn to år, må du varsle oss senest fem år etter at du mottok varene.

    Partene skal forsøke å løse eventuelle tvister i minnelighet. Kjøperen kan ta kontakt med Forbrukerrådet (www.forbrukerradet.no) for å få bistand i en eventuell tvist med selger.     BUYER’S DEFAULT

    The Buyer may cancel the purchase of the Product at any time for any or no reason within seven working days, beginning on the day after he/she received the Product. The right of cancellation may be exercised even if the Product is free from defects and either before or after the Product has been delivered. Where the Product has been delivered and the Buyer wants to cancel the purchase, the Buyer must return the Product to the Seller. The Seller will bear the costs of returning the Product and will refund the price paid.     PRODUCT NOT IN ACCORDANCE WITH ORDER, DEFECTIVE OR DAMAGED ON DELIVERY

    When the Buyer receives the Product, he/she should examine whether or not the Product is in accordance with the Order and whether the Product has been damaged during transport or whether the Product suffers from defects. If the Product is not in accordance with the Order, has been damaged during transport or suffers from defects, the Buyer must give notice to the Seller in accordance with section 9. The Seller will refund or replace Products which are damaged, defective or not in accordance with the Order on delivery.

    CLAIMS IN THE EVENT OF DEFECTS OF THE PRODUCT AFTER DELIVERY

    If at any time after delivery the Product is found to be defective, the Buyer must, within reasonable time after the Buyer became aware of the defect, send a notice to the Seller of the defect. This must be done no later than two months from when the defect was discovered by the Buyer. Where the Product is defective, the Buyer must return the defective Product to the Seller. The Seller shall bear the costs of returning the Product and will refund or replace the defective Products.

    DEFAULT INTEREST

    If the Buyer does not submit the payable amount price in accordance with the Agreement, the Seller may charge interest in the amount of 1,5%.

    PERSONAL INFORMATION – PRIVACY

    The Seller will process the Buyer’s personal information to comply with its obligations under the Agreement. The Seller will also use the Buyer’s personal information to inform the Buyer of Products similar to those purchased by the Buyer, unless the Buyer tells the Seller that he/she does not want to receive such information.

    Where the Buyer has provided his/her prior consent, the Seller may use the Buyer’s personal information for sending the Buyer advertising material or information on the Seller’s Products different from those purchased by the Buyer. Such voluntary and informed consent may be given by the Buyer upon entering into the Agreement.

    DISPUTE RESOLUTION AND JURISDICTION

    The parties shall try to settle any disputes amicably. If an amicable settlement cannot be reached, the matter shall be subject to the jurisdiction of the Finnish courts.

    This Agreement and any dispute or claim arising out or in connection with the subject matter of this Agreement will be governed by the laws of Finland.

    AVTAL – HELLY HANSEN

    1.PARTER

    Webbplatsen www.hellyhansen.com (webbplatsen) drivs av Helly Hansen AB, organisationsnummer 556280-4913, (säljaren), med registrerad adress på Stormbyvägen 2-4, 163 55 Spånga, Sverige. Säljarens momsregistreringsnummer är SE 556280491301. Köparen är den person som anges som köpare på ordern (köparen). Säljaren tillhandahåller de produkter (produkter) som finns på webbplatsen.
    Dessa försäljningsvillkor utgör, tillsammans med ordern och orderbekräftelsen, den fullständiga kontraktsgrunden för köpet (avtalet).

    2.PRISER

    De priser som anges på webbsidan är inklusive moms men exklusive frakt.     Säljaren kan, i den omfattning som anges i gällande lagstiftning, inte hållas ansvarig för och är inte bunden av skriv- eller stavfel i kommunikationen med köparen.
    Om produkten inte finns i lager kan säljaren komma att ge köparen information om liknande produkter.
    För att få handla från webbplatsen måste köparen vara över 18 år, ha rättskapacitet att ingå bindande avtal samt handla för eget bruk och inte med avsikt att sälja vidare. Säljaren förbehåller sig rätten att annullera beställningar som görs av köpare med avsikt att sälja produkterna vidare.

    4.BETALNING

    Säljaren accepterar betalning med MasterCard, Visa och PayPal. Säljaren debiterar inte köparens betal- eller kreditkort förrän produkten har skickats iväg. Säljaren kan neka köparens beställning om köparens betal- eller kreditkort inte godkänns.

    5.LEVERANS ETC.

    Varorna levereras till den adress som anges i orderbekräftelsen. Köparen väljer leveranssätt från de alternativ som ges vid beställning.
    Leveransdatum beror på det leveranssätt som köparen valt och anges på orderbekräftelsen. Om mer än en produkt har beställts, förbehåller sig säljaren rätten att skicka produkterna i separata försändelser.

    6.ÄGANDERÄTT TILL PRODUKTEN

    Äganderätt till produkten övergår till köparen först när säljaren har fått full betalning för alla fordringsbelopp som kan hänföras till produkten. Om leveransdatum har passerat utan att köparen sett till att få produkten levererad till sig efter det att produkten finns tillgänglig för köparen, bär köparen ansvaret för eventuell förlust eller skada på produkten.

    7.ANNULLATIONSRÄTT

    Köparen kan häva köpet av produkten när som helst och oavsett anledning inom sju arbetsdagar, räknat från dagen efter att hon/han tagit emot produkten. Rätten att häva köpet kan utövas även om produkten är felfri och antingen före eller efter att produkten har levererats. Om produkten har levererats och köparen vill häva köpet, måste köparen returnera produkten till säljaren. Säljaren står för returkostnaderna och återbetalar det belopp som köparen betalat. När köparen returnerar en produkt till säljaren på grund av att köparen har hävt avtalet i enlighet med avsnitt 7, hanterar säljaren återbetalningen till köparen så snart som möjligt och alltid inom 30 dagar från det att säljaren mottagit den returnerade produkten.

    8.PRODUKTEN ÖVERENSSTÄMMER EJ MED ORDER ELLER ÄR DEFEKT/SKADAD VID LEVERANS

    När köparen erhåller produkten ska hon/han undersöka om produkten stämmer överens med ordern samt om produkten har skadats under transport eller är defekt. Om produkten inte stämmer överens med ordern, har skadats under transport eller är defekt, måste köparen meddela säljaren i enlighet med avsnitt 9.     9.FORDRINGAR VID DEFEKT PRODUKT EFTER LEVERANS

    Om köparen efter leverans upptäcker att produkten är defekt måste hon/han, inom rimlig tid efter att defekten upptäcktes, meddela detta till säljaren. Detta måste göras inom två månader från det att köparen upptäckte defekten.     These conditions of sale constitute, together with the Order and the Order Confirmation, the total contractual basis for the purchase (the “Agreement”).

    SELLER’S DEFAULT

    BUYER’S DEFAULT

    If the Buyer does not fulfil its obligations under the Agreement, and the non-fulfilment is not due to the Seller or circumstances for which the Seller is liable, the Seller may, depending on the circumstances, exercise the rights under applicable Irish consumer law.

    If the Buyer does not submit payment according to the Agreement, the Seller can choose to confirm the Agreement and demand that the Buyer pays the purchase amount (fulfilment). In the event of material breach of the payment obligation or other material breaches of the Agreement, the Seller may terminate the Agreement. The Seller can also choose to cancel the Agreement if the Buyer does not submit payment within a reasonable extended period of time determined by the Seller.

    PRODUCT NOT IN ACCORDANCE WITH ORDER, DEFECTIVE OR DAMAGED ON DELIVERY

    When the Buyer receives the Product, he or she should examine whether or not the Product is in accordance with the Order and whether the Product has been damaged during transport or whether the Product suffers from defects.

    CLAIMS IN THE EVENT OF DEFECTS AND PERIOD ALLOWED FOR CLAIMS IN THE EVENT OF DELAYS

    If the Product has a defect, the Buyer must, within reasonable time after the Buyer became aware of the defect, make a default notice to the Seller and of his intention to make a claim. This must be done no later than thirty days from when the defect was discovered by the Buyer. Any notices of default and notices of claims must be made by calling customer service at 1.866.376.4183.

    BUYER’S DEFAULT

    If the Buyer does not submit payment according to the Agreement, or payment is rejected or denied (in the case of payment by credit, debit or bank card), the Seller can cancel the Agreement.

    The Seller will collect and store personal information that is necessary in order for the Seller to be able to comply with the obligations under the Agreement.

    DISPUTE RESOLUTION AND JURISDICTION

    The parties shall try to settle any disputes amicably. If an amicable settlement cannot be reached, the matter shall be settled before the courts.
    Unless otherwise provided for by applicable law, this Agreement shall be governed by and construed in accordance with the laws of the State of Washington. Exclusive venue for any action brought hereunder shall be the state and federal courts located in King County, Washington.

    AGREEMENT – HELLY HANSEN

    1. VERTRAGSPARTNER

    Die Webseite www.hellyhansen.com (nachfolgend: “Webseite”) wird betrieben von Helly Hansen Austria GmbH, Firmenbuchnummer 169/9331, (nachfolgend: “Verkäufer”), Firmensitz c/o AMT Steuerberatungsgesellschaft mbH, Am Modenapark 10/17, A-1030 Wien. Die Umsatzsteuer-Identifikationsnummer des Verkäufers lautet ATU42498203. Als Käufer wird die Person bezeichnet, die in der Bestellung angegeben ist (nachfolgend: “Käufer”). Der Verkäufer vertreibt die auf der Webseite angebotenen Produkte (nachfolgend: “Produkte”).
    Die vorliegenden Verkaufsbedingungen, die Bestellung und die Bestellbestätigung bilden gemeinsam die vertragliche Grundlage für den Kauf (nachfolgend: “Vertrag”).

    2. PREISE

    3. VERTRAGSSCHLUSS

    Der Verkäufer bestätigt den Eingang der Bestellung auf elektronischem Wege. Alle Bestellungen müssen vom Verkäufer angenommen werden. Da die Empfangsbestätigung keine Annahme der Bestellung darstellt, wird der Verkäufer dem Käufer die Annahme der Bestellung in Form einer E-Mail mitteilen, in der der Versand der Ware bestätigt wird (nachfolgend: “Bestellbestätigung”). Der Käufer hat zu prüfen, ob die Bestellbestätigung hinsichtlich der Anzahl der bestellten Artikel, der Art der Artikel, des Preises usw. mit der Bestellung übereinstimmt. Abweichungen von der Bestellung müssen dem Verkäufer unverzüglich gemeldet werden, entweder durch Anklicken der Kontakt-Schaltfläche http://www.hellyhansen.com/customer-service oder durch Kontaktieren des Verkäufers unter der Telefonnummer 0800 293 353.
    Soweit gesetzlich zulässig, kann der Verkäufer nicht haftbar gemacht werden für und ist nicht gebunden an Schreib- oder Tippfehler im Schriftverkehr mit dem Käufer.
    Ist ein Produkt nicht vorrätig, kann der Verkäufer dem Käufer Alternativartikel vorschlagen.
    Um auf der Webseite einkaufen zu können, muss der Käufer das 18. Lebensjahr vollendet haben und geschäftsfähig sein. Ferner muss er als natürliche Person auftreten und darf die Ware nicht mit dem Ziel der gewerblichen Weiterveräußerung bestellen. Der Verkäufer behält sich das Recht vor, Bestellungen von Käufern zu stornieren, die Bestellungen mit dem Ziel der gewerblichen Weiterveräußerung aufgeben.

    4. ZAHLUNG

    Der Verkäufer akzeptiert die Zahlung mit Mastercard, Visa und Paypal. Der Verkäufer belastet die Debit- oder Kreditkarte des Käufers erst dann, wenn das Produkt versendet wurde. Die Bestellung ist für den Verkäufer nicht bindend, wenn die Zahlung per Debit- oder Kreditkarte abgelehnt wird.

    5. LIEFERUNG U.A.

    Die Lieferung erfolgt an die in der Bestellbestätigung angegebene Adresse. Der Käufer hat die Auswahl zwischen den bei der Bestellung angebotenen Lieferarten.
    Der Liefertermin hängt von der vom Käufer gewählten Lieferart ab und wird auf der Bestellbestätigung angegeben. Wenn mehr als ein Produkt bestellt wird, behält sich der Verkäufer das Recht vor, die Produkte in getrennten Sendungen zu verschicken.

    6. EIGENTUM DER WARE

    Das Eigentum an der Ware geht erst dann auf den Käufer über, wenn der Verkäufer die vollständige Bezahlung aller fälligen Beträge in Bezug auf das Produkt erhalten hat. Ist der Lieferzeitpunkt eingetroffen und ermöglicht der Käufer die Lieferung der Ware nicht, obwohl das Produkt auslieferbereit ist, geht die Gefahr des Verlusts und der Beschädigung der Ware auf den Käufer über.

    7. WIDERRUFSRECHT

    Der Käufer kann den Kauf des Produkts jederzeit und aus jedem beliebigen Grund innerhalb von sieben Werktagen nach Erhalt der Ware widerrufen. Vom Widerrufsrecht kann auch Gebrauch gemacht werden, wenn das Produkt mängelfrei ist, und unabhängig davon, ob das Produkt geliefert wurde. Wurde das Produkt bereits geliefert und will der Käufer den Kauf widerrufen, muss der Käufer die Ware an den Verkäufer zurücksenden.
